Disorderly Conduct is second degree misdemeanor (punishable by not more than 60 days jail and not more than $500 fine). This crime is one of the most common misdemeanor offenses. The problem is that there is no clear cut definition as to what type of behavior constitutes Disorderly Conduct. The statute uses very vague and subjective terms, such as “breach of peace,” which unfortunately vests a great deal of discretion in the hands of police.
